The Policy governs the manner in which the platform collects, uses, maintains, and discloses information potentially collected from visitors, subscribers, and users of the platform (e.g. clients of Cascade School of Music) . This Privacy Policy applies to all events and materials offered through cascadeschoolofmusic.org.

In order to operate our sites effectively, we may collect personal information in a variety of ways, including but not limited to, subscribe to a form or newsletter, enroll in private lessons or group class, or in connection with other activities, services, features, or resources we make available through the website. Such information may include but is not limited to, your name, phone number, email address, mailing address, billing and payment information, profile information, log data (information such as your computer, Internet Protocol address (“IP”), pages that you visit on the site (or related Opus1 platform for the Program) and the amount of time spent on those pages, actions you take and other statistics), We will collect personal identification information only if users of the site voluntarily submit such information to us. You can refuse to supply personal identification information but doing so may prevent you from engaging in website activities and offerings, or the Program itself. By deciding to provide the Information you agree to our methods of collections and use, as well to all other terms and provisions of this Privacy Policy.

In addition to information provided by visitors who sign-up or enroll in any Cascade School of Music offering, including responses to surveys and questionnaires and content voluntarily shared in forums or chats, we collect certain information from and about website users directly from our web server logs, cookies, and web beacons. 

Use of collected information

We may collect and use your personal identification information for the following purposes:

  • To create an account on the site and allow clients to log-in to their account and access the Program or other offerings.

  • To manage your account, provide client and customer support, and ensure quality service

  • To respond to enquiries, questions, or other requests; also to contact you or provide information, alerts and suggestions related to the Program or other offering

  • Billing-related issues

  • To measure and improve the quality, the effectiveness and the delivery of our services

We use several publicly available tools and information exchange resources including but not limited to, Instagram, Facebook, X (formerly Twitter), and a blog, and others (collectively "Social and General Information Tools"). Any information you provide or share while using Social and General Information Tools may be read, accessed, collected by that site and/or users of that site according to their Privacy Policy.

Visitors, customers, clients, and registrants of Cascade School of Music may find content on the site(s) that links to the websites and services of third parties. We do not control the content or links that appear on these websites and are not responsible for the practices employed by websites linked to or from our website. In addition, such websites or services, including their content and links, may be constantly changing. Third party websites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to the Cascade School of Music site, is subject to that website's own terms and policies.

Sharing your personal information

We do not sell, trade, or rent customer or clients’ personal identification information to others.

Cascade School of Music uses commercially reasonable procedures to protect your personal information against loss, theft, and misuse, as well as unauthorized access, disclosure, alteration and destruction. Using any Internet-based service carries inherent security risks, and no security system is impenetrable. Our systems, infrastructure, encryption technology, operation and processes are all designed, built and maintained with security and privacy as prime concern; we apply industry standards and best practices to prevent any unauthorized access, use, and disclosure. Cascade School of Music cannot guarantee the security of its databases or the security during transmission of the information you send via the Internet. Customers and clients are advised to take precautions to protect their personal information when on the Internet and only disclose information they want made public. We comply with or exceed all applicable federal laws, state laws, and regulations regarding data privacy.

For the purposes set out in this Privacy Policy, personal information may be transferred to, processed, stored and accessed by Cascade School of Music and third parties in the United States and in other jurisdictions where we or they operate. Courts and other authorities in these jurisdictions may, in certain circumstances, be entitled to access your personal information. By using the website, you consent to this transfer, processing, storage and access of personal information in and/or outside of the jurisdiction in which you reside.

Cascade School of Music, has the discretion to update this Privacy Policy at any time, and will acknowledge the latest revision in the “updated” date at the bottom of this page. We encourage visitors, clients, customers, and event registrants to frequently check this page for any changes. You acknowledge and agree that it is your responsibility to review this Privacy Policy periodically and become aware of modifications.

Your acceptance of these terms

By using our site, subscribing to any form, enrolling in any offering, including but not limited to River’s signature coaching program, you signify your acceptance of this Privacy Policy. If you do not agree to this Privacy Policy, please do not use the site or sign-up or enroll. Your continued use of the site or the Opus1 learning platform following the posting of changes to this Privacy Policy will be deemed your acceptance of those changes.

By accessing the cascadeschoolofmusic.org website, you are agreeing to be bound by our Terms of Use, all applicable laws and regulations; you also agree that you are responsible for compliance with any applicable local laws. The following Terms of Use (the “Agreement”) governs your access and use of the online platform through which private lessons and group classes are provided (hereafter, collectively, the “Platform”). The Platform may be provided or be accessible via multiple websites or applications whether owned and/or operated by us or by third parties, including, without limitation, cascadeschoolofmusic.org, and cascadeschoolofmusic.opus1.io .

Please read this agreement carefully before using the Platform. If you do not agree with any of these terms, you are prohibited from using or accessing this site, created, owned, and operated by Cascade School of Music. The materials contained in this site are protected by applicable copyright and trademark law.

Use of Site

  1. You may view videos and materials on the cascadeschoolofmusic.org, and cascadeschoolofmusic.opus1.io website for personal, non-commercial transitory viewing only. You may not:

    • download the videos or use the site materials for any commercial purpose, or for any public display (commercial or non-commercial);

    • use the materials or repurpose them as your own for commercial purpose or financial profit

    • attempt to decompile or reverse engineer any software contained on the website;

    • remove any copyright or other proprietary notations from the videos or materials; or

    • transfer the materials to another person or 'mirror' the materials on any other server.

    • use this website to copy, store, host, transmit, send, use, publish or distribute any spyware, virus, worm, Trojan horse, time bombs, cancelbots, keystroke logger or other malicious computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information.

  1. Violation of any of these restrictions means your access may be terminated by Cascade School of Music, at any time. Upon terminating your access, you are not entitled to any refund, whether for the private lesson or class materials.

Intellectual Property

The Platform includes materials and videos protected by intellectual property laws, including without limitation written text, logos, photos, videos, music, art, PDFs, designs and/or graphics. Per the Use of Site agreement above, reproduction of materials on the Platform’s site shall constitute infringement. 

Privacy

Information on our security and privacy practices may be found on this site on the Privacy Policy page (the “Privacy Policy”).

By accepting this Agreement and/or by using the Platform, you also agree to the terms of the Privacy Policy, which is incorporated into and deemed a part of this Agreement. The same rules applying to changes and revisions of this agreement also apply to changes and revisions of the Privacy Policy. 

Program Comments, Interaction, and Chat

If you enroll in a private lesson or group class, you may be recorded or have your picture taken for promotional material and you represent and warrant that: (1) you are the owner of or have permission to share such materials; (2) you grant Cascade School of Music, a perpetual, royalty-free, worldwide non-exclusive license to use, copy, reproduce, publish, distribute, display your likeness, in whole or part, in any manner or medium, now known or hereafter developed, for any purpose, including commercial purposes and advertising. 

You may not communicate or submit any content or material that is abusive, vulgar, threatening, harassing, knowingly false, defamatory, or obscene or otherwise in violation of any law or the rights of others. Cascade School of Music, in its discretion, may delete or modify, in whole or part, any post, comment or submission to the Platform. Cascade School of Music, does not, however, have any obligation to monitor posts, comments, or material submitted by third parties. We neither endorse nor make any representations as to the truthfulness or validity of any third party videos, posts, comments, or material on our Platform. Cascade School of Music shall not be responsible or liable for any loss or damage caused by third-party posts, comments, or materials on the Platform

Cascade School of Music has not reviewed all the links to its website and is not responsible for the contents of any third-party linked site. The inclusion of any link does not imply endorsement by Cascade School of Music of the site. Any links beyond the Cascade School of Music site are subject to separate terms and conditions. Use of any such linked website is at the user's own risk, and Cascade School of Music is not responsible or liable for content on or actions taken by third-party websites. 

No Warranty

YOU HEREBY RELEASE US AND AGREE TO HOLD US HARMLESS FROM ANY AND ALL CAUSES OF ACTION AND CLAIMS OF ANY NATURE RESULTING FROM PRIVATE AND GROUP LESSON SERVICES OR THE PLATFORM, INCLUDING (WITHOUT LIMITATION) ANY ACT, OMISSION, OPINION, RESPONSE, ADVICE, SUGGESTION, INFORMATION AND/OR SERVICE, AND/OR ANY OTHER CONTENT OR INFORMATION ACCESSIBLE THROUGH THE PLATFORM. USE OF THE PLATFORM, IS AT YOUR OWN RISK.

THE INFORMATION, DIGITAL MATERIALS, AND SERVICES OFFERED ON OR THROUGH THIS WEBSITE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW,  CASCADE SCHOOL OF MUSIC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. CASCADE SCHOOL OF MUSIC DOES NOT WARRANT THAT THE PLATFORM OR ANY OF ITS FUNCTIONS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY PART OF THIS SITE, INCLUDING MEMBERSHIP PAGES, OR THE SERVERS THAT MAKE IT AVAILABLE, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

CASCADE SCHOOL OF MUSIC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES THAT RESULT FROM THE USE OF, OR THE INABILITY TO USE THIS PLATFORM, INCLUDING ITS MATERIALS OR SERVICES, OR THIRD-PARTY MATERIALS, PRODUCTS OR SERVICES MADE AVAILABLE THROUGH THIS SITE.

YOU UNDERSTAND, AGREE, AND ACKNOWLEDGE THAT OUR AGGREGATE LIABILITY FOR DAMAGES ARISING WITH RESPECT TO THIS AGREEMENT AND ANY AND ALL USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT OF MONEY PAID BY YOU THROUGH THE PLATFORM IN THE 3 MONTHS PERIOD PRIOR TO THE DATE OF ANY CLAIM.

If the applicable law does not allow the limitation of liability as set forth above, the limitation will be deemed modified solely to the extent necessary to comply with applicable law.

You will indemnify us, defend us, and hold us harmless from and against any and all claims, losses, causes of action, demands, liabilities, costs or expenses (including, but not limited to, litigation and reasonable attorneys' fees and expenses) arising out of or relating to any of the following: (a) your access to or use of the Platform; (b) any actions made with your account or Account Access whether by you or by someone else; (c) your violation of any of the provisions of this Agreement; (d) non-payment for services, including any portion of the Program, which were provided through the Platform; (e) your violation of any third party right, including, without limitation, any intellectual property right, publicity, confidentiality, property or privacy right. This clause shall survive expiration or termination of this Agreement.

This section (No Warranty) shall survive the termination or expiration of this Agreement.

Modifications, Termination, Interruption and Disruptions to the Platform

You understand, agree, and acknowledge that we may modify, suspend, disrupt, or discontinue the Platform, any part of the Platform or the use of the Platform, whether to all clients or to you specifically, at any time with or without notice. You agree and acknowledge that we will not be liable for any such actions or for any losses or damages that are caused by any of the aforementioned actions.

The Platform depends on various factors such as software, hardware, and tools, either our own or those owned and/or operated by third-party sites and vendors. While we make commercially reasonable efforts to ensure the Platform’s reliability and accessibility, you understand and agree that no platform can be 100% reliable and accessible , thus we cannot guarantee that access to the Platform will be uninterrupted or that it will be accessible, consistent, or error-free at all times.

Notices

We may provide notices or other communications to you regarding this agreement or any aspect of the Platform, by email to the email address that we have on record, by regular mail or by posting it online. The date of receipt shall be deemed the date on which such notice is given. Notices sent to us must be delivered by email to info@cascadeschoolofmusic.org

Site Terms of Use Modifications

Cascade School of Music may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

Governing Law

Any claim relating to the Platform or Program shall be governed by the State of Oregon, without regard to its conflict of law provisions. The nearest state and federal court to Bend, OR, shall have exclusive jurisdiction over any case or controversy arising from or relating to this website, including but not limited to the Privacy Policy or these Terms. By using this website, you hereby submit to the exclusive jurisdiction and venue of these courts and consent irrevocably to personal jurisdiction in such courts and waive any defense of forum non conveniens

If any provision of this Agreement is held by a court of competent jurisdiction to be illegal, invalid, unenforceable, or otherwise contrary to law, the remaining provisions of this Agreement will remain in full force and effect.

THIS AGREEMENT CONSTITUTES THE ENTIRE AGREEMENT BETWEEN YOU AND US. YOU CONFIRM THAT YOU HAVE NOT RELIED UPON ANY PROMISES OR REPRESENTATIONS BY US EXCEPT AS SET FORTH IN THIS AGREEMENT.
